Terms of Service for Hyve Intelligence

Welcome to Hyve Intelligence! These Terms of Service (“Terms”) govern your access to and use of the Hyve app (“App”), which includes our generative models, analytics tools, the AI-driven counseling services Tess and Dave, and other related offerings. By using the App, you agree to comply with these Terms in full. If you do not agree, please discontinue your use of the App.

Our goal is to provide an innovative, secure, and supportive environment for users. Please read these Terms carefully to understand your rights, responsibilities, and the limitations of our services.

1. Acceptance of Terms

By accessing or using Hyve, you acknowledge and agree to the following:

1.1 Eligibility:

You confirm that you are at least 16 years old or have reached the age of majority in your jurisdiction. If you are under the age of majority, you may only use the App with the involvement and consent of a parent or legal guardian who agrees to these Terms.

1.2 Legal Authority:

If you are using the App on behalf of a business, organization, or other entity, you warrant that you have the authority to bind that entity to these Terms.

1.3 Compliance:

You agree to comply with these Terms and all applicable laws, regulations, and guidelines governing your use of the App. Failure to comply may result in the suspension or termination of your account and access to the App.

If you disagree with any part of these Terms, you are prohibited from accessing or using the App.

2. Use of the App

Hyve is designed to provide innovative generative models, powerful analytics tools, and secure AI-driven counseling services called Tess and Dave. By using the App, you agree to use it responsibly and in accordance with these Terms.

2.1 Prohibited Activities:

You may not use the App to:

  • Violate any local, national, or international laws or regulations.
  • Upload, post, or share content that is defamatory, offensive, harmful, or infringes on the rights of others.
  • Interfere with the App’s functionality or security, including attempting to hack, disrupt, or overload our systems.
  • Reverse-engineer, decompile, or disassemble any part of the App or its underlying code.
  • Impersonate another person or entity, or misrepresent your affiliation with any person or organization.

2.2 Restrictions on Use:

You are granted a limited, non-exclusive, and revocable license to access and use the App for personal or authorized purposes. You may not use the App for commercial purposes without prior written consent from Hyve Intelligence.

We reserve the right to monitor and review your use of the App to ensure compliance with these Terms.

3. Account Responsibilities

To access certain features of the App, such as Tess and Dave, and other analytics tools, you may need to create an account. By creating an account, you agree to:

3.1 Providing Accurate Information:

You will provide truthful, accurate, and up-to-date information during registration. Failure to do so may result in account suspension or termination.

3.2 Maintaining Security:

You are responsible for keeping your account credentials confidential. You agree not to share your password or access your account on a public or insecure device.

3.3 Reporting Unauthorized Access:

If you become aware of any unauthorized use of your account, you must notify us immediately at support@gethyve.xyz. We are not liable for any damages or losses resulting from your failure to secure your account.

You are solely responsible for all activities conducted through your account, including any content shared or actions taken within the App.

4. Tess and Dave Counseling Service

Tess and Dave are AI-powered, confidential counseling services designed to provide emotional support and guidance. By using these services, you agree to the following terms:

4.1 Not a Substitute for Professional Care:

Tess and Dave are not replacements for professional medical or mental health services. For emergencies, you should contact local emergency services or a licensed healthcare provider immediately.

4.2 Privacy and Security:

Conversations with Tess and Dave are encrypted and remain private. Hyve Intelligence does not access or review these conversations unless required by law. However, you are responsible for ensuring that the device you use to access these services is secure and protected from unauthorized access.

4.3 Limitations of AI:

Tess and Dave are powered by artificial intelligence and provide responses based on available data. While we strive to make them accurate and supportive, they may not fully address all situations or provide personalized advice. Use your discretion when acting on information provided by Tess and Dave.

We are not liable for any decisions or actions you take based on your interactions with Tess or Dave.

5. Intellectual Property

The App and all related content, features, and functionality—including but not limited to text, graphics, logos, software, and designs—are the exclusive property of Hyve Intelligence or its licensors. They are protected under intellectual property laws, including copyright, trademark, and trade secret laws.

5.1 Restrictions on Use:

You may not copy, modify, distribute, sell, or create derivative works based on any content or features of the App without our prior written permission.

5.2 Ownership of Content:

Any feedback, suggestions, or ideas you provide to us regarding the App will become the exclusive property of Hyve Intelligence without compensation or acknowledgment.

Unauthorized use of our intellectual property may result in legal action.

6. Privacy and Data Security

Hyve Intelligence takes your privacy seriously. By using the App, you consent to the collection, processing, and storage of your data in accordance with our Privacy Policy.

6.1 Data Collection:

We collect limited personal information, including names, email addresses, and rough geographic locations, to provide and improve our services.

7.3 User Decisions:

Hyve Intelligence is not responsible for any decisions or actions you take based on information provided by the App, including interactions with Tess or Dave.

8. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without prior notice, for reasons including but not limited to:

  • Violations of these Terms.
  • Activities that harm the integrity, security, or functionality of the App.

You may terminate your account at any time by contacting us at support@gethyve.xyz. Upon termination, your data will be handled in accordance with our Privacy Policy.

9. Changes to These Terms

Hyve Intelligence reserves the right to modify these Terms at any time to reflect changes in our services, legal obligations, or business practices.

Significant changes to these Terms will be communicated through the App or via email.

9.2 Acceptance of Changes:

Your continued use of the App after updates are posted constitutes your acceptance of the revised Terms.
